1. Acceptance of Terms

By accessing or using the Dominick DeCarlo website ("Service"), booking performances, or using HypnoHelp services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Services Offered

2.1 The HYPNOVIDEO™ Show

Professional stage hypnosis performances for various venues including casinos, cruise ships, corporate events, colleges, and private functions. Each performance is customized to the venue and audience.

2.2 HypnoHelp Services

Personalized hypnosis services designed to help with fears, phobias, life challenges, addictions, and pain management. HypnoHelp is provided for informational and self-help purposes only.

3. Booking and Contracts

3.1 Event Bookings

• All event bookings require a signed contract and deposit
• Pricing varies based on event type, location, date, and requirements
• Contract terms supersede these general Terms for specific events
• Booking inquiries do not constitute a confirmed booking until contract is signed

3.2 Cancellation Policy

• Client Cancellation: Deposits are non-refundable. Cancellations within 30 days of the event date forfeit 50% of total fee; within 14 days forfeit 100%
• Force Majeure: In case of circumstances beyond reasonable control (natural disasters, illness, etc.), we will work with you to reschedule or provide a partial refund
• Performer Cancellation: If we must cancel, we will provide a full refund or offer alternative date

4. Payment Terms

4.1 Payment Processing

• All payments are processed securely through Stripe
• We accept major credit cards and debit cards
• Payment information is transmitted directly to Stripe and not stored on our servers
• All prices are in USD unless otherwise specified

4.2 Deposits and Payment Schedule

• A non-refundable deposit (typically 50%) is required to secure booking dates
• Final payment is due 14 days prior to the event date
• Late payments may result in cancellation of the booking
• Additional fees may apply for special requirements or travel expenses

4.3 Refunds

• Deposits are non-refundable in all circumstances
• Refunds for cancellations are subject to the cancellation policy outlined above
• Refund processing may take 5-10 business days
• Refunds are issued to the original payment method

5. Client Responsibilities

• Venue Requirements: Client is responsible for providing suitable venue with adequate space, lighting, sound system, and power
• Audience Size: Minimum audience size requirements may apply
• Safety: Client must ensure a safe environment for the performance
• Permissions: Client must obtain all necessary permits and permissions for the event
• Accurate Information: Provide accurate event details including date, time, location, and expected attendance

6. Hypnosis Disclaimer

6.1 Entertainment Purposes

Stage hypnosis performances are for entertainment purposes only. Participation is voluntary, and volunteers can stop at any time.

6.2 HypnoHelp Disclaimer

IMPORTANT: HypnoHelp services are NOT a substitute for professional medical, psychological, or psychiatric treatment. We are not licensed medical or mental health professionals.

• Results vary by individual; we make no guarantees of specific outcomes
• If you have a medical or mental health condition, consult your healthcare provider before using hypnosis
• Do not use HypnoHelp while driving or operating machinery

6.3 Contraindications

Hypnosis may not be suitable for individuals with certain conditions, including but not limited to:

• Epilepsy or seizure disorders
• Severe mental illness (schizophrenia, psychosis, etc.)
• Certain personality disorders
• Active substance abuse

Consult your healthcare provider if you have any concerns about whether hypnosis is appropriate for you.

7. Intellectual Property

• All content on this website, including text, graphics, logos, and performances, is the property of Dominick DeCarlo
• HYPNOVIDEO™ is a trademark of Dominick DeCarlo
• You may not reproduce, distribute, or create derivative works without written permission
• HypnoHelp content is licensed for personal use only and may not be shared or redistributed

8. Recording and Photography

• Recording of performances requires prior written consent
• Client may photograph performances for promotional purposes with credit
• We may photograph and record events for our own promotional use unless otherwise agreed
• Audience members participating in stage performances consent to being photographed and recorded

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid for the service
• We are not responsible for injuries or damages resulting from audience participation in performances
• We are not liable for outcomes or results from HypnoHelp services
• Client assumes all risk for venue-related issues and audience safety

10. Indemnification

You agree to indemnify and hold harmless Dominick DeCarlo from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your breach of these Terms
• Your violation of any law or rights of third parties
• Venue-related issues or audience safety concerns
• Your use of HypnoHelp services

11. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

12. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of modified Terms.

13. Governing Law and Disputes

• These Terms are governed by the laws of the State of Arizona
• Disputes shall be resolved in the courts of Arizona
• You agree to attempt good faith resolution of disputes before litigation
• If any provision is found unenforceable, the remainder remains in effect

14. Entire Agreement

These Terms, together with our Privacy Policy and any signed event contracts, constitute the entire agreement between you and Dominick DeCarlo regarding use of our Service.
